These Terms of Service ("Terms") govern your access to and use of lavimd.store (the "Site") and any products, services, content, features, or communications offered through the Site, operated by Chayim Therapeutics dba Lavi MD ("Lavi MD," "we," "us," or "our").
By accessing the Site, creating an account, placing an order, or otherwise using the Site, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree to these Terms, do not use the Site.
These Terms contain a binding arbitration provision and a class action waiver that affect your legal rights. Please review the Dispute Resolution section carefully.
1. Eligibility
You must be at least 18 years of age and able to form a legally binding contract to use the Site or purchase any product. By using the Site, you represent and warrant that you meet these requirements and that all information you provide is accurate, current, and complete. The Site is intended for users located in the United States.
2. Medical Disclaimer
The content on the Site, including product descriptions, blog posts, and other materials, is provided for general informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Nothing on the Site constitutes medical advice or establishes a physician and patient relationship.
Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition, medication, or treatment. Never disregard professional medical advice or delay seeking it because of something you have read on the Site. If you think you may have a medical emergency, call your doctor or 911 immediately.
You are solely responsible for evaluating whether any product is appropriate for you and for consulting a licensed healthcare provider before use.
3. Prescription Products and Physician Review
Certain products offered on the Site, including peptide nasal sprays and injectable preparations, may require a valid prescription and review by a licensed physician prior to fulfillment. By placing an order for any such product, you authorize a reviewing physician to evaluate the information you provide.
We reserve the right to decline, cancel, or refund any order that is not approved by a reviewing physician, that we believe may be unsafe or inappropriate, or that does not comply with applicable law. Approval is not guaranteed. Submission of an order does not guarantee fulfillment.
You agree to provide accurate and complete health information and to use all products strictly in accordance with the instructions and guidance provided by your prescribing or reviewing physician.
4. Regulatory Disclaimer
Statements regarding dietary supplements and related wellness products have not been evaluated by the Food and Drug Administration. These products are not intended to diagnose, treat, cure, or prevent any disease. Individual results may vary. Product availability, formulations, and labeling are subject to change and to applicable federal and state regulations.
5. Products, Pricing, and Availability
We strive to display products and pricing accurately. However, we do not warrant that product descriptions, images, pricing, or other content on the Site are accurate, complete, reliable, current, or error free. Colors and packaging may differ from images shown.
All prices are listed in U.S. dollars and are subject to change without notice. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information, including pricing, at any time without prior notice, even after you have submitted an order. Product availability is not guaranteed and offers may be limited in quantity.
6. Orders and Acceptance
Your submission of an order constitutes an offer to purchase. All orders are subject to our acceptance, and we may, in our sole discretion, refuse, limit, or cancel any order for any reason, including suspected fraud, pricing errors, product unavailability, failure of physician review, or violation of these Terms.
We may require additional verification or information before accepting any order. If we cancel an order after you have been charged, we will issue a refund to your original payment method.
7. Payment
By providing a payment method, you represent that you are authorized to use it and you authorize us, or our third party payment processors, to charge the full amount of your order, including applicable taxes and shipping, to that payment method. We are not responsible for any fees imposed by your bank or card issuer. We do not store full credit card numbers on our own servers.
8. Subscriptions and Recurring Billing
If you enroll in a subscription, you authorize us to charge your payment method on a recurring basis according to the plan you select, until you cancel. By starting a subscription, you acknowledge that it continues automatically and that you will be charged at the then current price plus applicable taxes and shipping for each billing cycle.
You may cancel your subscription at any time from your account page or by emailing support@lavimd.store. Cancellation takes effect before the next billing cycle. Products already shipped are not eligible for refund under the subscription cancellation policy. Additional terms are set out in our Return and Refund Policy.
9. Shipping and Delivery
Shipping timeframes are estimates only and are not guaranteed. Risk of loss and title for products pass to you upon our delivery to the carrier. Certain temperature sensitive products are shipped on designated days to protect product integrity. We are not responsible for carrier delays, weather events, or other circumstances beyond our reasonable control.
10. Returns and Refunds
Returns, refunds, cancellations, and handling of damaged or defective products are governed by our Return and Refund Policy, which is incorporated into these Terms by reference. Due to the nature of our products, opened or used items are generally not eligible for return.
11. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms or that we believe pose a risk to the Site, our customers, or our business.
12. Acceptable Use
You agree not to:
- Use the Site for any unlawful, fraudulent, or unauthorized purpose
- Resell, redistribute, or commercially exploit any product without our written authorization
- Provide false, misleading, or inaccurate information
- Attempt to gain unauthorized access to the Site, accounts, or systems
- Introduce viruses, malware, or other harmful code
- Scrape, harvest, or collect data from the Site using automated means without permission
- Interfere with or disrupt the operation, security, or integrity of the Site
- Infringe the intellectual property or other rights of Lavi MD or any third party
13. Intellectual Property
All content on the Site, including text, graphics, logos, the Lavi MD name and marks, images, product names, and design elements, is owned by or licensed to Chayim Therapeutics dba Lavi MD and is protected by intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works from any content without our prior written consent.
14. User Content
If you submit reviews, comments, photos, or other content to the Site, you grant us a non exclusive, royalty free, worldwide, perpetual, and transferable license to use, reproduce, display, and distribute that content in connection with our business. You represent that you own or control the rights to any content you submit and that it does not violate these Terms or any third party rights. We may remove any content at our discretion.
15. Third Party Links and Services
The Site may contain links to or integrations with third party websites, platforms, and services. We do not control and are not responsible for the content, policies, or practices of any third party. Your use of third party services is at your own risk and subject to their terms.
16. Disclaimer of Warranties
The Site and all products and services are provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non infringement. We do not warrant that the Site will be uninterrupted, secure, or error free, or that any product will meet your expectations or produce any particular result.
17. Limitation of Liability
To the fullest extent permitted by law, in no event will Chayim Therapeutics dba Lavi MD, its officers, directors, employees, affiliates, physicians, or service providers be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of the Site or any product, whether based on warranty, contract, tort, or any other legal theory, even if advised of the possibility of such damages.
To the fullest extent permitted by law, our total aggregate liability for any claim arising out of or related to the Site or any product will not exceed the amount you paid to us for the product or order giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
18. Indemnification
You agree to indemnify, defend, and hold harmless Chayim Therapeutics dba Lavi MD and its officers, directors, employees, affiliates, physicians, and service providers from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the Site, your violation of these Terms, your misuse of any product, or your violation of any law or third party right.
19. Dispute Resolution and Arbitration
Please read this section carefully. It affects your legal rights and requires individual arbitration instead of court proceedings or class actions.
Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any product, that cannot be resolved informally, will be resolved by binding individual arbitration rather than in court, except that either party may bring an individual claim in small claims court where eligible. Arbitration will be administered under the rules of a recognized arbitration provider, and judgment on the award may be entered in any court of competent jurisdiction.
Class Action Waiver. You and Lavi MD agree that each may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims.
Opt Out. You may opt out of this arbitration agreement by sending written notice to support@lavimd.store within 30 days of first accepting these Terms. Opting out will not affect any other provision of these Terms.
20. Governing Law and Venue
These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws principles. Subject to the arbitration provision above, you agree that any legal action not subject to arbitration will be brought exclusively in the state or federal courts located in Florida, and you consent to their jurisdiction.
21. Termination
We may suspend or terminate your access to the Site or your account at any time, with or without notice, for any reason, including violation of these Terms. Provisions that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution, will survive.
22. Changes to These Terms
We may update these Terms from time to time. Any changes will be posted on this page with a revised effective date. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
23. General
These Terms, together with our Privacy Policy and Return and Refund Policy, constitute the entire agreement between you and Lavi MD regarding the Site. If any provision is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any right or provision is not a waiver of that right or provision. You may not assign these Terms without our consent. We may assign our rights and obligations at any time.
